The Senate supported the following motion from Greens Leader Bob Brown:
That the Senate supports the Geneva Convention and opposes the failure to implement the convention regardless of by whom or where they may be breached
The motion passed without dissent.
After the motion was passed, Senator Brown called for Prime Minister Howard to immediately insist that the Geneva Conventions be applied to Guantanamo Bay detainees, including Australian citizen David Hicks.
Senator Brown said Hicks had been deprived of the protection of the conventions for the past five years, with the Howard government acquiescing.
